the deal, in plain language.

the agreement

by making a pop chat account you agree to these terms and to our privacy policy. pop chat is developed and operated by octa devs. if you do not agree, do not make an account — there is nothing to clean up if you never start.

your account

• you need to be old enough to enter a contract where you live. if you are under 18, do not make an account.
• your handle and your credential are yours. do not share your password.
• one account per person. we may close accounts that look automated or duplicated.
• tell us if someone else gets into your account. we would rather help than wait.

your handle

you pick it, so you have to keep it civil. no harassment, no slurs, no impersonating someone else, no handles that impersonate a company or a public figure. we may release or change a handle that breaks this rule, and we will tell you why.

you can give up a handle at any time. once released, we will not hand it back — treat the name you choose as something you might want to keep.

acceptable use

do not use pop chat to:

• harass, threaten, or threaten violence toward anyone.
• send unsolicited bulk messages, or automate message sending.
• send malware, or use the app to break the law where you are.
• pretend to be someone else in order to deceive another person.
• scrape, resell, or mine the service for other people’s data.

if you do any of these, we may suspend or close the account. we will normally tell you first, unless keeping the account open would hurt someone.

your content

the messages you send are yours. you keep the right to send them. we hold them for as long as your account exists, or until you delete them or your account, so that we can deliver them — that is the only reason we need them.

you are responsible for what you send. if you send something unlawful, we may be required to hand it over, and we may have to remove it.

availability

we aim to keep pop chat running, but we do not promise it will never be down. messages can fail to deliver, and we may need to pause the service for maintenance or safety. we will not pretend a message arrived when it did not — a failed send is shown as a failed send.

no warranty

pop chat is provided as it is. to the extent the law allows, we make no promise that it will be uninterrupted, error-free, or fit for a particular purpose. we are a small team and we would rather tell you that plainly than write a paragraph designed to survive a lawyer.

liability

to the extent the law allows, octa devs is not responsible for indirect or consequential loss arising from your use of pop chat — including lost messages, lost business, or lost opportunities. nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.

ending it, and changes

you can stop using pop chat and delete your account whenever you want. we can also close or suspend an account that breaks these terms. if we close your account, we will tell you why.

if these terms change, we will update the date at the top of this page. continuing to use pop chat after a change means you accept the updated terms.
